Fairfax County Teens Make and Distribute Child Porn

Children between the ages of 14 and 16 videotaped themselves having sex using an iPhone. They later distributed the videos to friends. Because the kids are underage, by definition, that is called pandering and because they shared the video, its called distribution. Funny that their lawyers doesn’t seem to understand these legal terms.

Lawyers for three Fairfax County high school students arrested for possession and distribution of child pornography are disputing the allegations and say the teens were involved in consensual sex.

Rod Leffler, defense attorney for the youngest West Springfield High School boy charged, says one of the boys merely used his smartphone camera to videotape friends having consensual sex at a party.

“They were all foolish,” Leffler tells WUSA 9.

Leffler says the videos don’t show that the girls were incapacitated or passed out.

“The girls are speaking directly to the cellphone camera,” says Leffler.

The attorneys for the three boys, whose ages range from 14 to 16, say the videos were shared among friends but never uploaded to the Internet.

Leffler basically admitted to the crimes of these teens. Under child porn distribution, the victims don’t have to be incapacitated, and the video doesn’t have to go on the internet in order for sharing to have occurred. And if the kids texted the video to one another, how does Leffler think the data got from one phone to the other without going across the Internet?
